Matthew Branic has a diverse practice focused primarily in the areas of business, commercial and government litigation and covering a wide range of industry groups and public agencies. Mr. Branic has been involved with complex litigation matters for various industry sectors, including financial institutions, health care, commercial real estate, manufacturing, and aerospace.
Prior to rejoining Krieg DeVault, Mr. Branic served in the public sector as an attorney with the Indiana Family and Social Services Administration’s Office of General Counsel, where he advised the agency on legal matters involving Medicaid. In such capacity, he provided legal counsel to the agency on the expansion of the Healthy Indiana Plan (“HIP 2.0”) and was one of the principal drafters of the emergency rule implementing the program. He has also served as a Deputy Attorney General with the Office of the Indiana Attorney General where he acted as litigation counsel representing various state agencies, including Department of Health, Department of Correction, Family and Social Services Administration, and Department of Child Services, in a variety of civil litigation matters.
Mr. Branic has been involved in cases dealing with breach of contract, fraud, constructive fraud, conversion, wage and compensation claims, antitrust, RICO, misappropriation of trade secrets, employment law and discrimination issues, covenants not to compete, negligence, products liability, shareholder disputes, commercial evictions, defamation, and creditors' rights. His practice has included cases in federal and state courts, both trial and appellate, ranging from the Seventh Circuit Court of Appeals down to small claims trials. Additionally, Mr. Branic has experience handling complex electronic discovery issues, collection matters, mental health commitments and administrative matters.
Representative Experience
- Lead counsel representing the Indiana Family and Social Services Administration in federal class action litigation brought by the ACLU involving Medicaid dental coverage limits
- Lead counsel representing the Indiana Office of Early Childhood and Out-of-School Learning in several preliminary injunction enforcement actions against child care homes
- Counsel of record representing the Indiana Department of Mental Health and Addiction in a Title VII sexual harassment claim filed in federal district court
- Counsel of record in a bench trial in Lake County involving breach of contract and quantum meruit allegations against the Indiana State Armory Board
- Counsel of record representing large aerospace manufacturer in complex commercial litigation involving trade secret misappropriation, conversion and antitrust claims, among others
- Counsel of record representing one of the defendant trustee banks in a large class action lawsuit involving a pre-need funeral trust
- Involved in various shareholder disputes and limited liability company member disputes, representing both the majority and minority side
- Represented large Indiana banking institution in its efforts to comply with Department of Justice Consent Order
- Represented several Indiana mental health facilities in various mental health commitment matters
- Counsel of record in discovery matter involving patent infringement claims, representing large non-party engine manufacturer
- Represented the City of Logansport, Indiana as outside counsel in civil rights action filed by multi-family housing landlord, at both the federal district court level and Seventh Circuit Court of Appeals
