Further, the use of telemedicine is governed by the location of the patient.  Krieg DeVault’s telemedicine team is well-versed to help providers expand their practice and deliver quality service through the use of telemedicine with their in-depth knowledge of the applicable regulations across all states as well as the Interstate Medical Licensure Compact.

Krieg DeVault has provided a variety of services in the constantly evolving field of telehealth and telemedicine, including the following:

  • Assisted with drafting provisions of the Indiana Code that implemented the new telemedicine requirements during the 2016 General Legislative Session, specifically, a provider’s ability to practice telemedicine from other states.
  • Advised a national healthcare provider on the requirements and limitations for reimbursing telemedicine services under federal medical assistance programs (Medicare/Medicaid) and private insurance.
  • Advised healthcare providers on the ability to prescribe controlled substances through telemedicine.  
  • Successfully pursued changes to Indiana’s telemedicine statute during the 2017 General Legislative Session, including permitting reimbursement to Medicaid providers who provide telemedicine services, and clarifying how providers may prescribe controlled substances to patients through telemedicine in order to provide access to mental health and substance abuse medications.
  • Represented a national healthcare provider in enrolling in a telehealth pilot program before a state licensing board.
  • Advised a national healthcare provider on a multi-state telehealth analysis and cross-border arrangements.
  • Worked with the Indiana Office of Medicaid Policy and Planning to ensure new Medicaid requirements related to credentialing for telehealth services are being timely implemented.  
  • Negotiated contracts for telehealth services with providers and telehealth technology companies.
  • Advised pharmaceutical company on telepharmacy laws in multiple states.
